Проблемы в преодолении конфликтов между горнодобывающими компаниями и местным населением

Для разрешения конфликтов между горнодобывающими компаниями и местным населением было предложено многоразличных подходов. Экспертом Гани Абдирасыловым был предложено создание открытого акционерного общества на базе горнодобывающих компаний и распределение части простых акций среди местного населения. По его мнению, это предотвратит конфликты, так как местные жители сами станут собственниками и будут заинтересованы в прибыльности компании. Однако, создание открытого акционерного общества на базе горнодобывающих компаний может привести к опасным и непредсказуемым последствиями.


  1. Местное население, в большинстве своем, не имеет юридического образования, не владеет навыками владения и управления простыми акциями. Далеко не каждый житель периферии видит ценность во владении акциями горнорудной компании, так как ему важнее доход в виде денежных средств или материальных ресурсов. Среди местного населения нет высокого уважения к праву собственности и существует печальная практика, когда некоторые местные жители незаконно присваивали и портили имущество компаний. Не всем жителям прилегающих к месторождению сел будет интересно становиться акционером горнодобывающей компании.
  2. Акционированное горнодобывающих компаний и распределение акций среди местного населения может создать риск дестабилизации стратегических отраслей Кыргызстана. После этого могут последовать требования части местного населения подобным методом акционировать другие стратегические объекты и передать акции (например, угольные предприятия в г. Таш-Комур, ртутный комбинат в г. Хайдаркан и так далее. Подобные требования будут сопровождаться стихийными митингами, перекрытиями дорог, препятствием работы предприятий, столкновениями с работниками компании и правоохранительными органами, что негативно отразиться на экономической и общественно политической ситуации в стране.
  3. Значимая часть населения, проживающая в регионах Кыргызстана подвержена влиянию некоторых политиков. В силу децентрализации власти и неподчинения центру некоторые ключевые вопросы решают местные лидеры, влиятельные лица. Используя популистские лозунги, в борьбе за власть, многие из них могут использовать местное население, чтобы требовать рассмотрение вопроса об акционировании важных стратегических предприятий. Для них данный шаг будет способом зарабатывать себе политические дивиденды.
  4. Акционирование горнодобывающих компаний и распределение долей простых акций среди местного населения приведет к возникновению новых завышенных требований. Местное население будет требовать распределение акций на бесплатной основе, в большем объеме, чем это предусмотрено. Есть вероятность, что в конечном итоге, жители сел прилегающих к месторождению просто потребуют приобретения всего пакета акций предприятия. Поскольку данное требование абсолютно невыполнимо, это приведет к новому витку конфликта.
  5. Следует учитывать несовершенство законодательства Кыргызской Республики, регулирующее рынок ценных бумаг и порядок их обращения. Существует ряд законодательных коллизий и пробелов, что создаст дополнительные сложности в правовом регулировании оборота ценных бумаг, находящихся на руках у населения.


Экспертом Искендером Шаршеевым было предложено использовать метод «социального договора». Это подразумевает открытую отчетность инвестора перед местным населением, проживающего вблизи месторождения. Населению предоставляется развитая социальная инфраструктура, взамен оно отказывается конфликта и даже может защитить инвестора в случае от других групп. Также экспертом был предложен подход с условным определением «аманат», когда горнодобывающая компания оплачивает учебу детям некоторых неформальных лидеров в стране и за рубежом. Попадая, таким образом, в зависимость от инвестора неформальные лидеры отказываются от несанкционированных и вредоносных действий.
В методе «социального договора» существует риск нарушения договора со стороны неформальных лидеров. Практика показывает, что не все неформальные лидеры придерживаются взятых на себя обязательств. Они также могут тайно использовать недовольных людей из других мест и руководить митингом не вступая в прямой конфликт с горной компанией. Это делает бессмысленным весь механизм.


Акционирование и договор с неформальными лидерами не могут стать однозначно эффективным решением.

Необходима кропотливая работа с местным населением изнутри, где идет полное разъяснение о роли горнодобывающей компании в экономике страны, о выгодах государства и населения, о правах и обязанностях сторон договоров и соглашений, и о возможности местных лидеров и политиков использовать такие противоречия в своих корыстных интересах.

Некоторые вопросы договора концессии полезных ископаемых в Кыргызстане

Некоторые вопросы использования концессии в Кыргызской Республике.
Основная особенность концессии состоит в том, что объекты договорных отношений, главным образом месторождение, находятся в безраздельном, монопольном обладании только у государства или иного публично-правового образования. С другой стороны выступает частное лицо, принимающее на себя определенные обязательства в обмен на предоставляемые ему права. Частным лицом может быть как юридическое лицо, так и индивидуальный предприниматель.
В данном случае соглашение о концессии, в рамках рассмотрения теории права, изначально выступает, в виде акта наделения права (дарения, пожалования, уступки) со стороны государства, которые недоступны или ограниченно доступны в гражданском обороте.
Согласно статье 1 Закона Кыргызской Республики «О концессиях и концессионных предприятиях в Кыргызской Республике» от 6 марта 1992 года концессией признается разрешение Правительства Кыргызской Республике инвестору на осуществление определенного вида предпринимательской деятельности, связанной с предоставлением ему во временное пользование имущества, земли и ее недр.
Также в статье 1 закона Кыргызской Республики «Об инвестициях в Кыргызской Республике» от 27 марта 2003 года, инвестициями в качестве материальных и нематериальных вложений, находящихся в собственности или контролируемых прямо или косвенно инвестором, в целях получения прибыли или достижения полезного эффекта также признается концессия на поиск, разработку, добычу или эксплуатацию природных ресурсов страны.
Статья 15 закона Кыргызской Республики «О недрах» от 2 июля 1997 года установлено, что концессия на пользование недрами предоставляется на конкурсной основе в соответствии с законом «О концессиях и иностранных концессионных предприятиях в Кыргызской Республике». Плата за концессию устанавливается в зависимости от природной ценности месторождения и не может быть меньше рентной прибыли от его освоения на момент подписания концессионного договора.
Следует отметить, что существует законопроект «О горной концессии». В данном законопроекте определяется понятие «горная концессия» как право, возникающее на основании договора между Кыргызской Республикой, в лице Правительства Кыргызской Республики или Уполномоченного государственного органа по недропользованию (Концендент) и пользователем концессии (концессионером), на эксплуатацию объекта горной концессии.
Исходя из статей вышеперечисленных нормативных актов концессия включает в себя передачу государством недропользователю право пользования как таковое или исключительное право пользования месторождением.
Главной особенностью концессионного соглашения служит наличие в нем публично-правовых мотивов, элементов и условий. В отличие от гражданско-правовой сделки – это, прежде всего, особые основания для возникновения концессионных правоотношений односторонний властный акт государства или иного органа публичной власти. Такой акт — источник возникновения всех видов концессионных правоотношений.
Такое право пользования, тем более исключительное право пользования на месторождении не может быть аналогом арендного права. Концессия сопоставима здесь с титульным арендным владением и пользованием, но в действительности полнее, весомее, «качественнее» арендных прав.
Уместно в этой связи отметить, что по законодательству Германии, Франции и ряда других стран концессионеру предоставляется право на «горную собственность» и, хотя это понятие достаточно условно (уже хотя бы потому, что предоставляется временно). Тем не менее, оно выводит концессионное право пользования за пределы арендных отношений.
Действующее законодательство Кыргызской Республики предоставляет недропользователю исключительные права того же типа и объема, которые соответствуют зарубежному праву «горной собственности». Здесь также присутствие требование к имуществу. Ведь право пользования которым предоставляется концессионеру, должно быть предварительно очищено от любых чужих прав на него. Это означает, что в концессию передается в виде казенного имущества государства или муниципальных образований. Кроме того, концедент предоставляет право пользования концессионеру.
Концессия предоставляется путем проведения конкурса. Для конкурса уполномоченные органы в соответствии с их сферами ведения готовят список объектов, предлагаемых для концессий. Затем этот перечень утверждается Правительством Кыргызской Республики, также как и порядок проведения конкурсов.
В настоящее время условия и порядок предоставления концессии и заключения концессионного договора регулируется Законом Кыргызской Республики «О концессиях и концессионных предприятиях в Кыргызской Республике», Гражданским Кодексом, законом Кыргызской Республики «Об инвестициях в Кыргызской Республики» и другими нормативными актами.

В рамках рассмотрения публично-правовых особенностей договорных отношений о концессии, следует обозначить исключительный или монопольный характер прав, предоставляемых государством (концедентом) недропользователю (концессионеру). Договор концессии заключается между Правительством Кыргызской Республики, другим уполномоченным либо специально созданным органом и концессионером. В роли концессионера здесь могут выступать иностранные государства, юридические и физические лица, а также совместные предприятия, зарегистрированные по законодательству Кыргызской Республики.

В пределах определенной территории или определенного вида деятельности, на которую концессионер получает исключительное право, не допускается аналогичная деятельность любых третьих лиц, а также самого концедента.
Говоря о понятии исключительности прав на определенный объект или вид деятельности в правовой науке Кыргызстана, важно знать, что оно признается, но в ограниченных отраслях права, например в отрасли интеллектуальной собственности. Применительно к горнодобывающей отрасли особенность исключительных прав, предоставляемых концедентом концессионеру, заключается в прерогативе концедента как органа публичной власти. Следовательно, эта прерогатива и служит источником исключительности на разведку и добычу полезных ископаемых на месторождении.
Подтвердить это суждение можно тем, что в зарубежной практике во многих концессионных договорах объектом исключительных прав является не имущество концедента, а вид деятельности – добыча полезных ископаемых.
Следует, однако, подчеркнуть, что предоставляемые концессионеру правомочия, сколь бы широкими и исключительными они ни были, никогда не меняют правосубъектности концессионера. Концессионер всегда частное лицо. Концессионный договор не может быть актом делегирования публичных, властных полномочий вышестоящего государственного органа нижестоящему. А, следовательно, нельзя на этом основании требовать от недропользователя чрезмерных и завышенных действий направленных на улучшения благосостояния местного населения и повышение потенциала социально-экономического сектора региона.
Таким, образом, исходя их вышесказанного под концессией на полезные ископаемые понимается санкционированный государством акт возмездной уступки на ограниченный срок и на строго определенных условиях частному лицу (концессионеру) известной части своих функциональных правомочий – в данном случае разведку и добычу полезных ископаемых.

Согласно статье 11 Закона Кыргызской Республики «О концессиях и концессионных предприятиях в Кыргызской Республике» платежи концессионера подразделяются на прямые и косвенные. Прямыми платежами являются:
- плата за концессию;
- арендная плата, размер которой устанавливается законодательством Кыргызской Республики;
- налоги, предусмотренные законодательством Кыргызской Республики.
Косвенными платежами являются:
- дополнительное инвестирование в народное хозяйство Кыргызской Республики;
- предоставление концессионером льготных кредитов;
- предоставление концессионером иных льгот юридическим и физическим лицам Республики Кыргызстан для развития торгово-экономического сотрудничества.
Под платой за концессию подразумевается твердая сумма в свободно конвертируемой или приравненной к ней валюте, размер которой определяется в ходе конкурса и является оценочной стоимостью концессионного объекта. Как правило, это платеж разовый и производится после государственной регистрации концессионного предприятия до начала его хозяйственной деятельности, если иное не предусмотрено договором.
Статья 5 проекта закона «О горной концессии» определяет состав правоотношений вытекающих из концессии на полезные ископаемые, где рассматривается несколько видов платежей:
- оговоренная доля собственности концендента в качестве рентного платежа за пользование имуществом;
- доля собственности концедента в концессионном объекте за счет собственных инвестиций;
- платежи за загрязнение окружающей среды;
- налоги и таможенные платежи;
- плата проведение оценки объекта концессии;
- плата за предоставление возможности пользования имеющейся геологической информацией об объекте концессии;
- иные платежи в соответствии с законом Кыргызской Республики «О концессии».
Государственное агентство по геологии и минеральным ресурсам при правительстве Кыргызской Республики разработало проект закона «О горной концессии». По мнению ведомства, привлечение инвестиций на основе концессии позволит совершить резкий скачок в развитии горнодобывающей отрасли. В настоящее время в существующий закон «О концессии» за годы своего действия, по их мнению доказал свою неэффективность. На основе концессионного договора в Кыргызстане работает только проект «Кумтор».

В отношении разработки месторождений полезных ископаемых срок действия концессии определяется до момента их полной добычи (истощения). Таким образом, концессия является своего рода альтернативой налоговому режиму, который устанавливает Налоговый кодекс.

How to reduce the conflicts with mining companies and locals. Kyrgyzstan - Talas - Andash - Djeruy (Conclusion)

Abstract
The Kyrgyz Republic is the third country in the Commonwealth of Independent States in terms of gold production after the Russian Federation and the Republic of Uzbekistan. At this point in the country there are more than thirty significant gold fields. Currently there are operated gold fields such as “Kumtor”, “Makmal” in The Kyrgyz Republic. In addition, there is a process of preparation for the development such gold fields like “Djeruy” and also “Andash” field[1].

Conclusion summarizing the findings
From all arguments, set forth above it follows that one of the main causes of the conflict is the weakness of the government in the face of law enforcement agencies (Ministry of law enforcement authority of the Kyrgyz Republic, the General Prosecutor of the Kyrgyz Republic) to ensure the safety of personnel and property of the mining companies.
Also, the problem appears and the fundamental inconsistency of strategies for the development of the Talas oblast between the government of the Kyrgyz Republic, the regional administrations, local communities and the mining company. In other words, there is no strategic vision for the development of the region as a whole.
In the process of making a decision to grant or revoke a license State agency for geology and mineral resources of the Kyrgyz Republic is not always take into account the interests of all sections and all sections of the community.
This in turn leads to a lack of infrastructure on the ground and the weakening of state power. Local people, dissatisfied with their present location and requires improving the conditions of life, but not from the state but from the mining company. This situation is in many ways, and creates the conditions for conflict than able to take an interest in obtaining material and financial resources group, as well as unfair competition. Consequently, the problem is as follows.

State power of the country must show the political will and ensure the safety for personnel mining companies and inviolability of private property. Develop a strategy for social-economic development of the Talas oblast through an open, comprehensive, city-state approach with the participation of all members of relations (list attached below).

The list of participants must be equipped with the following groups:
- Public authorities (State agency for geology and mineral resources of the Kyrgyz Republic, the agencies responsible for environmental safety, the Ministry of emergency situations of the Kyrgyz Republic, the Ministry of law enforcement authority of the Kyrgyz Republic, the General Prosecutor of the Kyrgyz Republic).
- Local authorities;
- The mining company, the investors;
- Associations that support the mining companies, the International Business Council;
- Representatives of the local population in the face: elders, elders, activists;
- Representatives of farms and cattle farms;
- Representatives of non-governmental organizations.
In this goal, the problem including enhanced continuous attention of the government, its agencies on the development and improvement of the living conditions of the population in the area and the region as a whole. This suggests the possibility to set measurable goals. It is possible the fixing of sustainable growth (rather than first, improving) the quality of health care and education (the state of the buildings, facilities, equipment), improving the quality of services provided by these institutions, the improvement of infrastructure, sustainable development of farming and animal husbandry in rural areas.
Equally important here is the construction, repair and improvement of the quality of infrastructure in the form of drainage systems, devices, potable water, electricity, roads, communication systems, radio and television broadcasting. In addition, farmers, ranchers, businessmen, and all other members of the local population is necessary to create conditions for the improvement of quality of life through the introduction of new technologies and farming methods (windmills, biogas plants, improvement suggestions).
The process of moving toward the goal should be monitored, as it is difficult to give a guarantee that the goal will be achieved on time. To do so may require joint efforts in the form of a joint collegial body as a supervisory commission. It will consist of government agencies, the heads of state of regional administrations, representatives of local authorities, representatives of the company, the local population.
In addition, it is important introduction to this alternative as a production sharing agreement based solely on the separation of produced products. The agreement must be designed, subjected to discussion and criticism not only by state authorities as ministries and agencies, investors, but also directly with those members of the local authority, where the proposed mine. In addition, the composition of the discussions should include representatives of the local authority and other cities in the region. It is important that the above persons with the concurrence of all the important questions have signed on behalf of the people they represent local authority.
So, at the very early development stage, it is recommended to increase the investor’s share to 70%, but included in that share the costs of the investor. Thus, the principle of openness will be developed. The remaining 30 percent is expected to divide between the public authority that regulates the mining industry, as well as the local authority, the areas of the field. In the future, the investor’s share will be lower, in favor of the state and the local community.
The state thus securing its presence and credibility not only as repressive of supervisory bodies (the bodies of internal affairs), but also in the form of qualified doctors, teachers, and school teachers will be able to provide normal living conditions of citizens. Thus, the problem of the relationship of mining companies and representatives of the communities will be able to stop at an early stage.

Abstract
The Kyrgyz Republic is the third country in the Commonwealth of Independent States in terms of gold production after the Russian Federation and the Republic of Uzbekistan. At this point in the country there are more than thirty significant gold fields. Currently there are operated gold fields such as “Kumtor”, “Makmal” in The Kyrgyz Republic. In addition, there is a process of preparation for the development such gold fields like “Djeruy” and also “Andash” field[1].

Another group from among the representatives of the local population has a greater influence on how decisions of local government and administration of the Talas oblast. For example, according to an analysis conducted by the Foundation for the Development of law and business, it was revealed that the local community and local authorities in the majority also do not support the discovery of deposits in their territory of the following reasons:
1) The representatives of the local government believe that the provision of sites for subsurface interests of the local population and the local government are not considered. This takes into account only the interests of the mining company and a certain part of the population is enriched at the expense of coming from the subsoil.
2) They are concerned about the state of the environment in which they live and the influence of mining on the health of local residents.
3) They fear that mining companies do not fulfill their obligations under the land reclamation and the local community will remain with the lands that are not subject to use.
4) In general, they believe that the disadvantages of mining in their territory prevail over the benefits[2].

The other group is the government body in the face of the State agency for geology and mineral resources of the Kyrgyz Republic, as well as the agencies responsible for environmental safety, the Ministry of emergency situations of the Kyrgyz Republic. In addition, it should be added to the State administration of Talas district and the State administration of Talas oblast. They, according to their functions and duties, regulators should act this relationship.
The next group performs the mining company and investors who plan to invest funds in the development of mineral resources in the field.
The state represented by the State agency for geology and mineral resources of the Kyrgyz Republic is interested in the normal and safe operation and development of the industry.
Agencies responsible for environmental safety, and the Ministry of emergency situations of the Kyrgyz Republic are interested in a stable state of ecological safety, the normal state of potentially dangerous objects (tailings), and in a safe or less harmful ways of processing and storage of mining products (for example, technology without the use of cyanide). The state has received funding from the company in the form of a subsoil user of statutory payments.
The representatives of the State administration of Talas district and the State Administration of Talas oblast mainly focused on socio-economic development of the oblast and strengthening its authority and influence in the field. They are also interested in the restoration and reconstruction of socially important facilities, to increase its capacity as guarantor of the security of citizens and investors of all types of ownership stability.
The mining company and investors: whose primary goal appears as a profit, are interested in the possibility to carry out mining activities in the field.
Interested parties: Government agencies. Particularly important group is state branch, in the face of the State agency for geology and mineral resources of the Kyrgyz Republic, responsible for environmental safety and the Ministry of emergency situations of the Kyrgyz Republic, the State administration of Talas district and the State Administration of Talas oblast. They are according to their functions and duties, regulators should act this relationship. Unfortunately, until recently, it was difficult to implement, since their policies they did not have to solve the problems.
Motivation: Public authorities are motivated to maintain stability in the Talas district, and in Talas oblast. For them, it is important to reduce the number of cases of conflicts between local communities and mining company. For the incidents as acts of violence against employees, damage, misappropriation of company property, the heads of state of regional administrations could suffer political responsibility in the form of dismissal or criminal liability for negligence as to their direct duties.
Beliefs: Public authorities are convinced that the strategy worked out by the state for the development of the mining industry should be executed as relevant government authorities and the company itself. Some of them believe that the creation of strategies are not in order of policy, without the involvement of a wide range of representatives of various interest groups is not a bar to his execution.
However, the representatives of the State agency for geology and mineral resources of the Kyrgyz Republic are convinced that mining companies do not fully take into account the interests of the local community. Also, some members of such bodies consider that the procedures providing for the license mining companies to be worked through.
Agencies responsible for environmental safety, and the Ministry of emergency stuations of the Kyrgyz Republic as a whole believe that around the field there is a threat of environmental catastrophe. All of them are convinced that mining companies must often check for violations of safety and environmental requirements. Agencies are interested in a stable condition of ecological safety, the normal state of potentially dangerous objects, as well as safe or less harmful methods of waste processing and storage of mining.
Sources: State agencies have various kinds of resources, one of which - the compulsion. Often, speaking not as an authority on reconciliation and the interests of all the interacting groups, and as a tool of repression, the government plays the role of fire service only in response to an exacerbation of conflicts.
The state also has a resource as a rule-making, the right to issue and revoke licenses. And most importantly, the state has the resources to form a new fully coherent strategy that is able to take into account the interests of all participants in a given relationship.
Efficiency: The state represented by the State agency for geology and mineral resources of the Kyrgyz Republic, is interested in the normal and safe operation and development of the industry.
Agencies responsible for environmental safety, and the Ministry of emergency situations of the Kyrgyz Republic have adequate powers to monitor and check all potentially dangerous techniques and methods of mining. They are also able to create an evidence base that certain actions mining companies do not have a lot of irreparable damage to nature in the field area.
State officials in the field are convinced that because the state is not able to and does not want to develop their infrastructure, it is obliged to do the mining company. In addition, the State administration of Talas district and the State administration of Talas oblast according to their functions and duties, can also make adjustments of this relationship.
Interested parties: The mining company and investors.
Motivation: The mining company and investors are aiming to invest funds in the development of mineral resources in the field and be sure to make a profit.
Beliefs: The mining company and investors are convinced that at this stage the state and local people have high expectations from the social-economic contribution of the region[3]. Investors difficult to find a common language with the local people, because he has not solved the social problems in the field. And for that they do not have to answer, and the state. Some representatives of the mining companies believe that the state does nothing to resolve the problem.
Resources: In addition, financial resources. Have developed mechanisms to establish good relations with the local population. The company is also able to conduct discussions with the public and to publish information on their activities, including in the local media and the local population. Investors and the Company have the opportunity to interact with the body that issues licenses to mining, anyway, lobbying for certain conditions of the industry in their favor.
The mining company and investors are able to keep the relationship and negotiations with government officials of different ranks, to lobby parliamentarians and certain regulations.
Efficiency: The mining company is able to effectively use the media and rumors among the local population opposing the misrepresentation on the part of competitors, materially interested activists and other interested groups. This will help us work out countermeasures to the argument that the real conflict - it is an obvious miscalculation of the company's management, its error. The mining company has some experience of working with activists from the local population to obstruct the work of the company. The company has the opportunity to interact with various government and non-governmental entities that are able to assist in resolving the conflict. Among them are organs of the state, the individual civil servants, police officers, the International Business Council and the Association of supporting mining companies.
Analysis of external forces
At the stage of identifying causes of the problem, we have found different groups that are involved in this relationships. It can be both interest groups and individuals. Need to think about collaboration with the necessary participants in the early stages of problem solving.
Interested parties: local competitors, foreign competitors.
Motivation: All competitors mining company focused on the creation of obstacles, trying, somehow, to take away her license for the development of mineral resources. Taking the place of the company, a competitor is able to make a profit.
Beliefs: The competitors of the company are confident that, through a secret campaign against the mining company of the local population, it will be possible to deprive it of the possibility of lead mining. All the issues of social-economic and political nature of the population can use it as a force counteracting the work and the simple physical presence of the mining company.
Resources: First of all, the competitors have significant financial resources. Competitors are well-equipped to campaign against the company in the media, the Internet, in the local population. In addition, competitors are able to form a negative image of the company as a license holder in the country and abroad.
The company’s competitors have the opportunity to interact with the body issuing licenses for mining, anyway, lobbying for this or that industry conditions, up to revocation of the license.
The company’s competitors have the ability to negotiate and maintain relationships with officials of different ranks, to lobby parliamentarians and certain regulations.
Effectiveness: Among the competitors there are a number of mining companies who effectively uses foreign and local media, highlighting a real conflict as an obvious miscalculation of the company’s management, its error. Other companies are able to use the powers of activists from the local population to obstruct the work of the company. Such companies also have opportunities to interact with different structures. Among them may be organs of the state, the individual civil servants, police officers, organized crime groups, and etc.

How to reduce the conflicts with mining companies and locals. Kyrgyzstan - Talas - Andash - Djeruy (Part III - bis1)

Abstract
The Kyrgyz Republic is the third country in the Commonwealth of Independent States in terms of gold production after the Russian Federation and the Republic of Uzbekistan. At this point in the country there are more than thirty significant gold fields. Currently there are operated gold fields such as “Kumtor”, “Makmal” in The Kyrgyz Republic. In addition, there is a process of preparation for the development such gold fields like “Djeruy” and also “Andash” field[1].

Part III. The analysis of the involved interested parties (stakeholders)
The representatives of the local people, who live in the immediate vicinity of the gold fıeld opposed to the mining company, could be under the effect of doubtful information, fraud and lack of awareness. At this point, they are exposed to the negative effects of some “external forces” that are interested in the acquisition of income form the mining company as a “compensation” for possible damage. Thus, locals are preventing normal operation at the gold field. By voicing different complaints of damage (which, however, does not approved), the local population begins to consider claims to mining companies as possibility to use a source of income. It is important to highlight the main stakeholders in this issue.
One of the largest and most diverse groups in this situation is local population of Talas oblast. It is also divided into subgroups. Each of which has own claims to the mining company. These are a individuals who uses a form of pressure on mining companies to obtain financial benefits, the group of politicians, lobbying for the interests of livestock owners, farmers, able-bodied citizens who wish to find a job. Collectively, these subgroups are pushing the total claim against the company.
The group of parties to conflict have following interests.
The local population:
One of the important aspects of the conflict - is the local population. In this research it is necessary to be careful, because the definition of “local population” is need to consider about its versatility. This diversity may be include various groups, including people who can be classified by age, location, occupation and so on.
“Serep” Research Institute is also consider it necessary to examine the local population in terms of economic activity. These groups may include:
- Livestock owners who are interested in preserving the environment and raise cattle graze.
- Farmers who are interested in the environmental safety of production resources (soil erosion control and irrigation water).
- Able-bodied citizens, expressing a desire to get a high-paying job.
The report of the Public Fund “Egalitee” (hereinafter - the Social fund) should be that public authority and mining company take into account solely the viewpoint of the population living in close proximity to the developments that do not fully reflect the position of the entire population.
Thus, according to the report of the Public fund of the active population (18 years and older) in village Beck-Moldo, located next to mine of “Djeruy” consists 2718 people, according to local government passport. The number of active residents village of Aral, located in close proximity to the mine “Taldy-Bulak”, there were 2,043 people according to the passport of the village in 2007, and the number of the active population of the village Kopuro-Bazaar, located in close proximity to the mine “Andash” of 2,504 people according to data of local government in 2007[2].
According to data of the National statistical committee of the Kyrgyz Republic, the average annual number of resident population of Talas oblast in 2010 is amounted to 230 400 people. From this amount 34 100 people are urban and 196,300 people are rural population[3].
These figures show a biased sample populations of whose opinion the government, local authority, mining company are supposed to take into account in attempt to resolve conflicts between mining companies and local population. Thus, even if surveys among 100% of the villages located near the fields will be conducted, public opinion does not represent in full and expanded form, as overlooked opinion of respondents from other villages.
In this view, it is necessary giver whole coverage of interests to identify all those people who live there in oblast.
According to the National statistics committee of the Kyrgyz Republic the resident population of Talas region in 2011 consisted 231,800 people. The economically active population who wishes to find a job in Talas oblast, (individuals aged from 18 years to 45 years), namely, could observe and understand all benefits of mining exploration at gold fields. Their statistical population is 94 002 people. Of this number, 14,553 people considered urban and 79,449 rural.
During the conflict between mining companies and local youth population also stands as the most active groups. In this case, we will consider young people aged from 15 years to 25 years. The sample population of Talas oblast according to the age groups shows the following. The total number of persons aged 15 years to 25 years is 50478 people.
There are 7265 people, whose opinion is taken into account by the mining company, as an arguments of public power. This part of the population is considered as a person who may encounter problems or receive benefits from mining. While the rest of the region's population remains on the sidelines.
Assuming that the development of the field could bring benefits to the entire population of the area, it is necessary to take into account the opinion of representatives throughout the area.
Note that the term “population” can be seen as naturally and historically folding continuously renew the process of production and reproduction of immediate life group of people. Population resident in the Talas oblast itself is multifaceted and includes various subgroups of the place of residence, age, social status and so on.
In majority the local population has a direct interest - receive material benefit from the mining company under the pretext of compensation for harm caused by a mineral development.
The motivation of the local population.
Summary – Local population are observing the opportunity to get easy income in the form of material aid from the mining company. Further - it is not adequate conditions of life, the reluctance of local people put up with it. Feel threatened by the presence of the mining company. Do not favorable living conditions, economic backwardness and a number of unsolved social problems of the local population’s tempting to search for the guilty.
Beliefs: As mining company covers local livelihoods, it is obliged to “pay” for their right to work in the field. The company is foreign; therefore, it has to pay for everything. General: The mining company pollutes nature, does not give people the promised work, strongly interferes with life, is a danger to local residents.
Such representatives of the local population as owners of livestock, farmers and other residents of surrounding villages to the field are convinced that mining companies will interfere with normal life. Their representatives repeatedly voiced that the cause of damage to pastures, soil, harm quantitative growth of livestock, destroying the natural objects of nature (lakes, forests).
The elders are convinced that the company infringes on the cultural and historical heritage (works near cemeteries and monuments). Also, the above-mentioned groups have expressed concerns about the demolition works that, in their opinion, can cause damage[4].
Able-bodied citizens who wish to find a job in the company, angry that she did not hire local people in large numbers. They believe that the company is able to hire the maximum number of able-bodied people, but their leadership simply does not want it.
Resources: Basic: the ability to distort information addressed by the media, the opportunity to present themselves and their status as a victim. Distance from the city center and allows local people to systematically distort information, use the conjectures and prejudices against the company. More: How to impede the work of: road closures, damage and appropriation of property of the company. The lack of responsibility for their actions. The large number of supporters.
Local communities have the opportunity to influence the decisions of the district administration and the state of the actions of the Interior, the Ministry of Emergency Situations. Also, they can be influenced by the media.
Efficiency: Certain persons, representatives of the local population (activists), using various forms of pressure on mining companies, find it possible to get rich at the expense of funds from companies claiming material means. Making frequent meetings and rallies, preventing normal operation of the company, they are thus turned into a source of operating income. An example is a message of Journalists of the newspaper “Vecherniyi Bishkek” Andrew and Irene Oreshina Sahakyan whose article states the following: “Rural activists announced that they did not even start production, the company is killing the environment, generates a mutation of cattle and undermines the health of women and children. The truth was revealed soon: a new investor conducted a study of the social situation of the village and identified products to support the most needy families. Other residents of village that humanitarian aid is not inherited, launched a storm of activity, calling to expel a foreign company”[5].
